People v Williams, 2024 NY Slip Op 00640 [224 AD3d 706]
February 7, 2024
Appellate Division, Second Department
[*1]
The People of the State of New York, Respondent,
v
Marcellous Williams, Appellant.
Kenyon C. Trachte, Newburgh, NY, for appellant.
David M. Hoovler, District Attorney, Goshen, NY (Robert H. Middlemiss of counsel), for respondent.
Appeal by the defendant from a judgment of the County Court, Orange County (Craig Stephen Brown, J.), rendered March 1, 2022, convicting him of attempted robbery in the first degree, upon his plea of guilty, and imposing sentence.
Ordered that the judgment is affirmed.
The record demonstrates that the defendant knowingly, voluntarily, and intelligently waived his right to appeal ( see People v Thomas , 34 NY3d 545 [2019]; People v Lopez , 6 NY3d 248 [2006]). The defendant’s valid waiver of his right to appeal precludes appellate review of his contention that the sentence imposed was excessive ( see People v Washington , 214 AD3d 910 [2023]; People v Stevens , 203 AD3d 958 [2022]). Dillon, J.P., Iannacci, Wan and Taylor, JJ., concur..
