People v Williams, 2020 NY Slip Op 01091 [180 AD3d 814]

February 13, 2020

Appellate Division, Second Department

[*1]

The People of the State of New York, Respondent,

v

Tyheem Williams, Appellant.

Paul Skip Laisure, New York, NY (Benjamin Welikson of counsel), for appellant.

Eric Gonzalez, District Attorney, Brooklyn, NY (Leonard Joblove and Keith Dolan of counsel; Maria Torres on the memorandum), for respondent.

Appeals by the defendant, as limited by his motion, from two sentences of the Supreme Court, Kings County (William Miller, J.), both imposed January 23, 2018, as amended January 29, 2018, upon his pleas of guilty, on the ground that the sentences were excessive.

Ordered that the sentences are affirmed.

The record demonstrates that the defendant knowingly, intelligently, and voluntarily waived his right to appeal ( see People v Sanders , 25 NY3d 337 , 340 [2015]; People v Spitzer , 163 AD3d 591 , 592 [2018]). The defendant’s valid waiver of his right to appeal precludes appellate review of his contention that the sentences imposed were excessive ( see People v Lopez , 6 NY3d 248 , 255-256 [2006]). Dillon, J.P., Austin, Roman, Hinds-Radix and Christopher, JJ., concur..
