People v Taylor, 2018 NY Slip Op 07159 [165 AD3d 1181]
October 24, 2018
Appellate Division, Second Department
[*1]
The People of the State of New York, Respondent,
v
Devvon L. Taylor, Appellant.
Thomas N. N. Angell, Poughkeepsie, NY (Steven Levine of counsel), for appellant.
William V. Grady, District Attorney, Poughkeepsie, NY (Kirsten A. Rappleyea of counsel), for respondent.
Appeal by the defendant from a judgment of the County Court, Dutchess County (Edward T. McLoughlin, J.), rendered June 5, 2017, convicting him of criminal possession of a weapon in the second degree, upon his plea of guilty, and imposing sentence.
Ordered that the judgment is affirmed.
The defendant’s contention that the County Court improvidently exercised its discretion in denying his preplea recusal application is foreclosed by the defendant’s valid waiver of the right to appeal ( see People v McMahon , 153 AD3d 728 , 729 [2017]). Balkin, J.P., Chambers, Roman, Maltese and Connolly, JJ., concur..
