People v Robinson, 2020 NY Slip Op 03426 [184 AD3d 779]

June 17, 2020

Appellate Division, Second Department

[*1]

The People of the State of New York, Respondent,

v

Demort Robinson, Appellant.

[Recalle and vacated, see 2020 NY Slip Op 07103.] Paul Skip Laisure, New York, NY (Sean H. Murray of counsel), for appellant.

Eric Gonzalez, District Attorney, Brooklyn, NY (Leonard Joblove and Terrence F. Heller of counsel; Isaiah Affron on the memorandum), for respondent.

Appeal by the defendant, as limited by his motion, from a sentence of the Supreme Court, Kings County (Alexander Jeong , J.), imposed October 17, 2017, upon his plea of guilty, on the ground that the sentence was excessive.

Ordered that the sentence is affirmed.

The defendant’s valid waiver of his right to appeal precludes appellate review of his contention that the sentence imposed was excessive ( see People v Bradshaw , 18 NY3d 257 , 265 [2011]; People v Ramos , 7 NY3d 737 , 738 [2006]; People v Lopez , 6 NY3d 248 , 255 [2006]).
