People v Pryor, 2019 NY Slip Op 07098 [176 AD3d 743]

October 2, 2019

Appellate Division, Second Department

[*1]

The People of the State of New York, Respondent,

v

Kevin Pryor, Appellant.

Janet E. Sabel, New York, NY (Katheryne M. Martone of counsel), for appellant.

Eric Gonzalez, District Attorney, Brooklyn, NY (Leonard Joblove and Rhea A. Grob of counsel; Anna Arena on the memorandum), for respondent.

Appeal by the defendant, as limited by his motion, from a sentence of the Supreme Court, Kings County (John T. Hecht, J.), imposed January 23, 2018, upon his plea of guilty (Alexander Jeong, J.), on the ground that the sentence was excessive.

Ordered that the sentence is affirmed.

The record demonstrates that the defendant knowingly, voluntarily, and intelligently waived his right to appeal ( see People v Sanders , 25 NY3d 337, 339-342 [2015]; People v Lopez , 6 NY3d 248, 256-257 [2006]). The defendant’s valid waiver of his right to appeal precludes appellate review of his contention that the sentence imposed was excessive ( see People v Lopez , 6 NY3d at 255-256). Rivera, J.P., Hinds-Radix, Brathwaite Nelson and Iannacci, JJ., concur..
