People v Marine, 2019 NY Slip Op 07282 [176 AD3d 869]
October 9, 2019
Appellate Division, Second Department
[*1]
The People of the State of New York, Respondent,
v
David Marine, Appellant.
Janet E. Sabel, New York, NY (Harold V. Ferguson, Jr., of counsel), for appellant.
Eric Gonzalez, District Attorney, Brooklyn, NY (Leonard Joblove and Thomas M. Ross of counsel; Marielle Burnett on the memorandum), for respondent.
Appeal by the defendant, as limited by his motion, from a sentence of the Supreme Court, Kings County (ShawnDya Simpson, J.), imposed November 14, 2017, upon his plea of guilty, on the ground that the sentence was excessive.
Ordered that the sentence is affirmed.
The defendant validly waived his right to appeal ( see People v Sanders , 25 NY3d 337 [2015]; People v Ramos , 7 NY3d 737 [2006]; People v Turbe , 165 AD3d 1297 [2018]). The defendant’s valid appeal waiver precludes review of his contention that the sentence imposed was excessive ( see People v Lopez , 6 NY3d 248, 255 [2006]; People v Batista , 167 AD3d 69 , 75 [2018]). Mastro, J.P., Leventhal, Miller, Duffy and LaSalle, JJ., concur..
