People v Jacobs, 2020 NY Slip Op 05528 [187 AD3d 786]

October 7, 2020

Appellate Division, Second Department

[*1]

The People of the State of New York, Respondent,

v

Gretchen Jacobs, Appellant.

Paul Skip Laisure, New York, NY (David L. Goodwin of counsel), for appellant.

Michael E. McMahon, District Attorney, Staten Island, NY (Morrie I. Kleinbart and Thomas B. Litsky of counsel), for respondent.

Appeal by the defendant, as limited by her motion, from a sentence of the Supreme Court, Richmond County (Alexander Jeong, J.), imposed April 3, 2018, as amended June 25, 2018, upon her plea of guilty, on the ground that the sentence was excessive.

Ordered that the sentence, as amended, is affirmed.

The record demonstrates that the defendant knowingly, voluntarily, and intelligently waived her right to appeal ( see People v Sanders , 25 NY3d 337 , 339-342 [2015]; People v Lopez , 6 NY3d 248 , 256-257 [2006]). The defendant’s valid waiver of her right to appeal precludes appellate review of her contention that the sentence imposed was excessive ( see People v Lopez , 6 NY3d at 255-256). Mastro, J.P., Leventhal, Miller, Duffy and LaSalle, JJ., concur..
