People v Grant, 2019 NY Slip Op 02548 [171 AD3d 791]
April 3, 2019
Appellate Division, Second Department
[*1]
The People of the State of New York, Respondent,
v
Elijah Grant, Appellant.
Paul Skip Laisure, New York, NY (Leila Hull of counsel), for appellant.
Eric Gonzalez, District Attorney, Brooklyn, NY (Leonard Joblove and Jill Oziemblewski of counsel; Marielle Burnett on the memorandum), for respondent.
Appeal by the defendant, as limited by his motion, from a sentence of the Supreme Court, Kings County (Michael A. Gary, J.), imposed May 25, 2017, upon his plea of guilty, on the ground that the sentence was excessive.
Ordered that the sentence is affirmed.
The record demonstrates that the defendant knowingly, voluntarily, and intelligently waived his right to appeal ( see People v Moore , 140 AD3d 1091 [2016]). The defendant’s valid waiver precludes review of his contention that the sentence was excessive ( see People v Colon , 165 AD3d 1163 [2018]). Balkin, J.P., Chambers, Roman, Maltese and Connolly, JJ., concur..
