People v Goddard, 2020 NY Slip Op 01079 [180 AD3d 804]

February 13, 2020

Appellate Division, Second Department

[*1]

The People of the State of New York, Respondent,

v

Nathan Goddard, Appellant.

Janet E. Sabel, New York, NY (Whitney Elliott of counsel), for appellant.

Eric Gonzalez, District Attorney, Brooklyn, NY (Leonard Joblove and Rhea A. Grob of counsel; Luc B. Walkington on the memorandum), for respondent.

Appeal by the defendant, as limited by his motion, from a sentence of the Supreme Court, Kings County (Dineen Ann Riviezzo, J.), imposed May 9, 2017, upon his plea of guilty, on the ground that the sentence was excessive.

Ordered that the sentence is affirmed.

The defendant’s valid waiver of his right to appeal precludes appellate review of his contention that the sentence imposed was excessive ( see People v Sanders , 25 NY3d 337 [2015]; People v Lopez , 6 NY3d 248 , 255-256 [2006]). Rivera, J.P., Maltese, Barros, Brathwaite Nelson and Iannacci, JJ., concur..
