People v Garbutt, 2019 NY Slip Op 06161 [175 AD3d 552]

August 21, 2019

Appellate Division, Second Department

[*1]

The People of the State of New York, Respondent,

v

Rudolph Garbutt, Appellant.

Paul Skip Laisure, New York, NY (Samuel Barr of counsel), for appellant.

Eric Gonzalez, District Attorney, Brooklyn, NY (Leonard Joblove and Seth M. Lieberman of counsel; Ruby D. Andrade on the memorandum), for respondent.

Appeal by the defendant, as limited by his motion, from a sentence of the Supreme Court, Kings County (Vincent M. Del Giudice, J.), imposed October 18, 2017, upon his plea of guilty, on the ground that the period of postrelease supervision imposed as part of the sentence was excessive.

Ordered that the sentence is affirmed.

The record demonstrates that the defendant knowingly, voluntarily, and intelligently waived his right to appeal ( see People v Sanders , 25 NY3d 337 , 340 [2015]; People v Ramos , 7 NY3d 737 , 738 [2006]; People v Lopez , 6 NY3d 248 , 256 [2006]; People v Batista , 167 AD3d 69 , 73 [2018]; People v Sabo , 117 AD3d 1089 [2014]). The defendant’s valid waiver of his right to appeal precludes appellate review of his contention that the period of postrelease supervision imposed as part of the sentence was excessive ( see People v Lopez , 6 NY3d at 255-256). Rivera, J.P., Hinds-Radix, Brathwaite Nelson and Iannacci, JJ., concur..
