Appeal by the defendant from a judgment of the Supreme Court, Queens County (Danielle Hartman, J., at plea; Gia Morris, J., at sentence), rendered July 30, 2018, convicting him of attempted criminal possession of a forged instrument in the second degree, upon his plea of guilty, and imposing sentence.
Ordered that the judgment is affirmed.
Contrary to the defendant’s contention, he is not entitled to vacatur of his conviction and dismissal of the accusatory instrument based upon the sentencing court’s error in pronouncing the sentence ( see People v Sparber , 10 NY3d 457 , 471-472 [2008]; People v Sturgis , 69 NY2d 816, 818 [1987]). Since the defendant is not entitled to the only remedy he seeks on this appeal, we affirm the judgment. Maltese, J.P., Duffy, Iannacci and Ford, JJ., concur..
