People v Clasablanca, 2018 NY Slip Op 06027 [164 AD3d 1255]

September 12, 2018

Appellate Division, Second Department

[*1]

The People of the State of New York, Respondent,

v

Thomas Clasablanca, Also Known as Thomas Casablanca, Appellant.

Paul Skip Laisure, New York, NY (David P. Greenberg of counsel), for appellant.

Richard A. Brown, District Attorney, Kew Gardens, NY (John M. Castellano, Johnnette Traill, and William H. Branigan of counsel; Rachel N. Houle on the memorandum), for respondent.

Appeal by the defendant, as limited by his motion, from a sentence of the Supreme Court, Queens County (Gene Lopez, J.), imposed October 26, 2016, on the ground that the sentence was excessive.

Ordered that the sentence is affirmed.

The record demonstrates that the defendant knowingly, intelligently, and voluntarily waived his right to appeal ( see People v Lopez , 6 NY3d 248 , 257 [2006]). The defendant’s valid waiver of his right to appeal precludes appellate review of his contention that the sentence imposed was excessive ( see People v Bradshaw , 18 NY3d 257 , 267 [2011]; People v Lopez , 6 NY3d at 255). Scheinkman, P.J., Austin, Miller, Hinds-Radix and Maltese, JJ., concur..
