People v Aisewomhanio, 2018 NY Slip Op 04335 [162 AD3d 786]

June 13, 2018

Appellate Division, Second Department

[*1]

The People of the State of New York, Respondent,

v

Kingsley Aisewomhanio, Appellant.

Paul Skip Laisure, New York, NY (Lisa Napoli of counsel), for appellant.

Eric Gonzalez, District Attorney, Brooklyn, NY (Leonard Joblove and Victor Barall of counsel; Robert Ho on the memorandum), for respondent.

Appeal by the defendant, as limited by his motion, from a sentence of the Supreme Court, Kings County (Joseph E. Gubbay, J.), imposed August 18, 2010, upon his plea of guilty, on the ground that the sentence was excessive.

Ordered that the sentence is affirmed.

Under the circumstances presented, the defendant did not knowingly, voluntarily, and intelligently waive his right to appeal ( see People v Bradshaw , 18 NY3d 257 , 264 [2011]; People v Lopez , 6 NY3d 248 , 256 [2006]). However, the defendant’s contention regarding his sentence is without merit. Scheinkman, P.J., Chambers, Sgroi, Maltese and Connolly, JJ., concur..
