Adam, a resident of New York, filed a lawsuit against Company, Inc., which is incorporated in New York, after Adam was in a motor vehicle accident while working an ice cream truck for the defendant in Connecticut. The defendant argues that New York’s no fault insurance law should apply, while the plaintiff argues that Vermont’s at-fault law should apply. Which state’s laws should apply?

In 2015, Michael was brought in for questioning on a homicide case where the perpetrator waxed the victim’s eyebrows off after the killing. Detectives suspected that Michael killed the victim, but never charged him of the crime. In 2020, Michael was arrested for killing a boy whose body was found without eyebrows. Can the prosecution use the uncharged crime as evidence in this 2020 case?

Lilly was called into the police station for questioning regarding a fire that occurred in her neighborhood. She has not been charged with arson and no formal judicial proceedings have begun, but she hired a lawyer anyway. When Lilly arrives at the station, four officers are waiting to question her. May the police officers proceed to question Lilly before her lawyer arrives?

Ann timely filed suit against Joe, a New York resident, in 2015. In January 2019, the action was terminated without reaching a final judgment. The statute of limitations for the cause of action expired in August 2018. May Ann file a new action based on the same transaction or occurrence?

Kate and Steve were hiking when Kate lost both of her diamond earrings. Steve found one of Kate’s earrings. Afterwards, she told him that she’d pay him $100 for finding it and pulled out a grocery receipt from her pocket and wrote, “I owe you $100.” Kate found the other earring one hour later. A week later, Steve went to collect the money, but Kate refused to pay because she found the other earring without him. Steve demanded the money, arguing that there was an enforceable contract. Is Steve correct?

Answer Explanations

After you submit your exam responses, you will see answer explanations for all questions that you got right and wrong. We recommend that you read through the answer explanations for questions you got right to double check that you got them right for the correct reason. And of course, to read the explanations to the questions you got wrong to find out why you got the answer wrong.
