Fraud as a Cause of Action in New York
“The prima facie elements of a cause of action for fraud are (i) a material misrepresentation of fact, (ii) made by the defendant with knowledge of its falsity, (iii) with an intent to induce the plaintiff’s reliance, (iv) justifiable reliance by the plaintiff, and (v) damages (Schneiderman v Credit Suisse Securities (USA) LLC, 31 NY3d 622, 638 [2018]).” Shanghai Nonobank Fin.
