In an action to foreclose a mortgage, the defendant 1009 Guyiti, LLC, appeals from an order of the Supreme Court, Kings County (Lawrence Knipel, J.), dated February 14, 2018. The order denied that defendant’s motion to vacate a prior order of the same court dated October 18, 2017, granting the plaintiff’s unopposed motion, inter alia, for summary judgment on the complaint insofar as asserted against that defendant and for an order of reference.

Ordered that the appeal is dismissed, without costs or disbursements.

The appeal from the order must be dismissed because the right of direct appeal therefrom terminated with the entry of the judgment of foreclosure and sale in the action ( see Matter of Aho , 39 NY2d 241, 248 [1976]). The issues raised on the appeal from the order are brought up for review and have been considered on the appeal from the judgment of foreclosure and sale ( U.S. Bank N.A. v 1009 Guyiti, LLC , 186 AD3d 1562 [2020] [decided herewith]; see CPLR 5501 [a] [1]).
