People v Dixon, 2018 NY Slip Op 06108 [164 AD3d 1359]
September 19, 2018
Appellate Division, Second Department
[*1]
The People of the State of New York, Respondent,
v
Shaquan Dixon, Appellant.
Carl D. Birman, White Plains, NY, for appellant.
Anthony A. Scarpino, Jr., District Attorney, White Plains, NY (Jennifer Spencer and William C. Milaccio of counsel), for respondent.
Appeal by the defendant, as limited by his motion, from two sentences of the Supreme Court, Westchester County (Barry E. Warhit, J.), both imposed January 5, 2017, upon his pleas of guilty, on the ground that the sentences were excessive.
Ordered that the sentences are affirmed.
The record demonstrates that the defendant knowingly, voluntarily, and intelligently waived his right to appeal ( see People v Sanders , 25 NY3d 337 , 339-342 [2015]; People v Lopez , 6 NY3d 248 , 256-257 [2006]; cf. People v Brown , 122 AD3d 133 , 145-146 [2014]). The defendant’s valid waiver of his right to appeal precludes review of his contention that the sentences imposed were excessive ( see People v Lopez , 6 NY3d at 255-256). Scheinkman, P.J., Roman, Cohen, Duffy and LaSalle, JJ., concur..
