People v Rivera, 2018 NY Slip Op 04574 [162 AD3d 912]

June 20, 2018

Appellate Division, Second Department

[*1]

The People of the State of New York, Respondent,

v

Joseph Rivera, Appellant.

Paul Skip Laisure, New York, NY (Sean H. Murphy of counsel), for appellant.

Richard A. Brown, District Attorney, Kew Gardens, NY (Christopher Blira-Koessler of counsel; Deanna Russo on the memorandum), for respondent.

Appeal by the defendant, as limited by his motion, from a sentence of the Supreme Court, Queens County (Barry Kron, J.), imposed December 19, 2016, on the ground that the sentence was excessive.

Ordered that the sentence is affirmed.

The record demonstrates that the defendant knowingly, intelligently, and voluntarily waived his right to appeal ( see People v Lopez , 6 NY3d 248 , 257 [2006]). The defendant’s valid waiver of his right to appeal precludes appellate review of his contention that the sentence imposed was excessive ( see People v Bradshaw , 18 NY3d 257 , 267 [2011]; People v Lopez , 6 NY3d 248 , 255 [2006]). Balkin, J.P., Chambers, Roman, Maltese and Connolly, JJ., concur..
