People v Jackson, 2022 NY Slip Op 01807 [203 AD3d 950]

March 16, 2022

Appellate Division, Second Department

[*1]

The People of the State of New York, Respondent,

v

Ramiek Jackson, Appellant.

Joseph F. DeFelice, Kew Gardens, NY, for appellant.

Anne T. Donnelly, District Attorney, Mineola, NY (Jason R. Richards and Jared A. Chester of counsel), for respondent.

Appeal by the defendant from a judgment of the Supreme Court, Nassau County (Teresa K. Corrigan, J.), rendered February 27, 2019, convicting him of promoting prostitution in the fourth degree, kidnapping in the second degree, and assault in the second degree, upon his plea of guilty, and imposing sentence.

Ordered that the judgment is affirmed.

The record demonstrates that the defendant knowingly, voluntarily, and intelligently waived his right to appeal ( see People v Thomas , 34 NY3d 545 [2019]; People v Lopez , 6 NY3d 248 , 256-257 [2006]). The defendant’s valid waiver of his right to appeal precludes appellate review of his contention that the sentence imposed was excessive ( see People v Lopez , 6 NY3d at 255-257; People v Zubradt , 198 AD3d 825 , 826 [2021]). Barros, J.P., Chambers, Maltese and Wooten, JJ., concur..
